They lay the groundwork for a balance between technological innovation and legal security, recognizing the essential role of <\/span><b>legal officers<\/b><span style=\"font-weight: 400;\"> in the validation of digital evidence.<\/span><\/p><h2><b>A Higher Standard for the Reliability of Digital Evidence<\/b><\/h2><p><span style=\"font-weight: 400;\">In a decision dated March 10, 2025 (No. 0472387), the French Conseil d\u2019\u00c9tat reaffirmed a fundamental principle: <\/span><b>digital evidence<\/b><span style=\"font-weight: 400;\">, even when accompanied by metadata (such as a time-stamped photograph), cannot be considered fully reliable if it is not secured by a trusted authority.<\/span><\/p><p><span style=\"font-weight: 400;\">Why? Because metadata\u2014technical information attached to a file, such as creation date, device used, or geolocation\u2014can be altered after the fact. In the context of a legal dispute, this vulnerability weakens the evidentiary weight of the document. In this case, the court upheld a previous decision that dismissed a series of photographs as evidence, ruling that their date could not be considered sufficiently authenticated.<\/span><\/p><p><span style=\"font-weight: 400;\">This position reflects a broader trend in European law: the demand for <\/span><b>authenticity, traceability, and integrity<\/b><span style=\"font-weight: 400;\"> in digital evidence, particularly when used in litigation.<\/span><\/p><h2><b>Blockchain: A Powerful but Non-Autonomous Tool<\/b><\/h2><p><span style=\"font-weight: 400;\">This raises a natural question: <\/span><b>Is blockchain sufficient to guarantee the integrity of digital evidence?<\/b><span style=\"font-weight: 400;\"> At first glance, yes\u2014public blockchains are known for being tamper-proof, decentralized, and time-stamped. But the legal reality is more nuanced.<\/span><\/p><p><span style=\"font-weight: 400;\">In the same decision, the Conseil d\u2019\u00c9tat specified that <\/span><b>only a legal officer<\/b><span style=\"font-weight: 400;\">, operating directly on the blockchain through their own node, can provide sufficient legal guarantees.<\/span><\/p><p><span style=\"font-weight: 400;\">Why? Because between the time a file is created and the time it is recorded on the blockchain, it can be altered. Only the involvement of a <\/span><b>public officer<\/b><span style=\"font-weight: 400;\">, recognized by the state, can ensure the certainty of the file\u2019s authenticity and timestamp.<\/span><\/p><p><span style=\"font-weight: 400;\">In other words: <\/span><b>blockchain is a tool\u2014but it does not replace the legal officer<\/b><span style=\"font-weight: 400;\">. It strengthens their report, but cannot stand on its own.<\/span><\/p><h2><b>Toward a Regulated Legal Recognition of Blockchain<\/b><\/h2><p><span style=\"font-weight: 400;\">This is where a second decision comes into play, delivered on March 20, 2025 by the Judicial Court of Marseille (No. 23\/00046). In this case, a blockchain timestamp report created through the <\/span><i><span style=\"font-weight: 400;\">BlockchainyourIP<\/span><\/i><span style=\"font-weight: 400;\"> platform by a legal officer was <\/span><b>fully recognized as valid proof of copyright ownership<\/b><span style=\"font-weight: 400;\">.<\/span><\/p><p><span style=\"font-weight: 400;\">The court affirmed that when a legal officer uses a blockchain anchoring solution to establish a report, the result <\/span><b>carries full evidentiary value<\/b><span style=\"font-weight: 400;\">. However, this recognition depends on a key element: the <\/span><b>direct and traceable involvement of the public officer<\/b><span style=\"font-weight: 400;\"> in the registration process.<\/span><\/p><p><span style=\"font-weight: 400;\">This ruling represents a significant step forward for creators, artists, companies, and platforms seeking to protect their rights in a digital environment.<\/span><\/p><h2><b>Consistent and Complementary Case Law<\/b><\/h2><p><span style=\"font-weight: 400;\">These two decisions are not contradictory\u2014on the contrary, they are perfectly complementary.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The first confirms that digital evidence, when left to stand alone, does not have sufficient probative force.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The second recognizes that blockchain can become a robust medium of proof, <\/span><b>only if<\/b><span style=\"font-weight: 400;\"> it is supported by the <\/span><b>intervention of a legal officer<\/b><span style=\"font-weight: 400;\">.<\/span><span style=\"font-weight: 400;\"><br \/><br \/><\/span><\/li><\/ul><p><span style=\"font-weight: 400;\">This coherence lays the foundation for a stable legal framework in the years ahead.
